USER AGREEMENT
✦ This agreement is a contract between you ("the Commissioner") and Umika Chi ("the Artist").
✦ By making an order and completing payment, you agree to comply with all of the terms and conditions listed below.
✦ Please read carefully before making a request.

ON PERSONAL USAGE
By default, the artwork is for personal use only.
The artwork is exclusively digital.
The commissioner may not claim ownership of the artwork, nor use it commercially whatsoever, such as in monetized platforms, reproduction and redistribution.
The Artist retains all rights, including intellectual property rights, to the commissioned artwork. The Artist may use the artwork for promotional or commercial purposes, including but not limited to prints, merchandise and online portfolios.
The Commissioner may choose to share the artwork to social media platforms, as long as credits to the Artist are provided.
The Commissioner may not share the high resolution files publicly, nor remove the watermark.
ON COMMERCIAL RIGHTS
The Commissioner can acquire Commercial Rights by requesting any of the following price tiers:
Tier 01: This tier is meant for promotional social media usage and/or branding (such as in Youtube and Twitch). The cost of this tier is +50% the total price. Crediting the Artist is mandatory.
Tier 02: In addition to the rights granted in Tier 01, the Commissioner may use and redistribute the artwork, digital (game assets, cover art, etc) or physical (keychains, body pillows, etc). The cost of this tier is +100% the total price.
ON REFUNDS
Refunds are not offered, except under very specific and exceptional circumstances. However, the artist will make every reasonable effort to address any concerns or issues the commissioner may have.
CONFIDENTIALITY
Under no circumstances may the Commissioner and Artist disclose each other's personal information to third parties.

ON REQUESTS
The Artist reserves the right to decline any requests without further explanation.
Estimates provided are subject to change and further details will be discussed.
The Artist has the responsibility to inform the Commissioner if any problems arise that may affect the progress of the order.
If the Commissioner requires faster completion or has short deadlines, the Artist may charge an extra fee accordingly.
If the Commissioner wishes for their artwork to remain private or to withhold the Artist from posting publicly for a specific period of time, a separate fee will be charged accordingly (except for Vtuber Models).
It is the customer's responsibility to provide flexible communication. The Artist will not be held responsible for late delivery due to the Commissioner's late responses.
The artist manages health challenges, streaming and other responsibilities outside of artwork. Therefore, harassment regarding the pace of work will not be tolerated.
ON ADJUSTMENTS
Once the sketch has been fully approved of, any further changes may incur additional charges.
Every artwork includes at least 03 revisions. Extra revisions may incur additional fees.
Small changes and mistakes by the Artist can be adjusted free of charge.
Major adjustments will incur an additional cost.
The artist will not be held responsible for any delays resulting from the requesting of excessive revisions and changes by the Commissioner, especially after prior approvals have been given.
ON ARTWORK DELIVERY
Upon completion, the Artist will provide both high resolution and resized versions of the artwork.
Artwork completion time may vay from 3 days to months, depending on the order complexity.
TERMINATION FOR MISCONDUCT
The contract may be terminated immediately if the Customer engages in disrespectful behavior, such as inciting conflict or violating agreed-upon terms.
